DISABILITY COMPLAINTS POLICY
Definitions.
- “Board” means the Kenton County Board of Elections or their designees
- “Complainant” means the person who provides or files a disability complaint, question, or issue or files an ADA complaint Form.
- “Title II” means Title II of the Americans with Disabilities Act of 1990, 42 U.S.C. §§ 12132.
Complaint Process
Any person who believes they have been discriminated against based on disability or that there has been a violation of any provision of Title II for the Board’s voting programs, services, or activities, including at any polling location, may file a complaint, written or oral, with the County Board of Elections.
A complainant can:

- Call the Voter office at 859-392-1620. A deputy clerk will fill out the ADA complaint form
- Speak to a poll worker during an election on site and provide a complaint orally or in writing to the poll worker
- Download the ADA COMPLAINT FORM and return to the County Clerk in person or by:
- mail at 1840 Simon Kenton Way, Covington KY 41011
- or e-mail rebecca.kassemos@ky.gov
- Please include:
- Date
- Complainant contact information: Full name, address, telephone number and e-mail.
- Identify the polling location.
- Include description of the main issue and/or alleged violation sufficient to apprise the board of specific issues.
If possible, be filed within sixty (60) days of the alleged violation of Title II but there is no strict deadline for filing a complaint.
Processing the Complaint Form
- If the complaint form is not complete the board shall, within three (3) days of receipt of the form, send the Complainant a notice explaining the information still needed to assess the complaint.
- Upon receipt of the complaint form, the board shall review the issues and work on a planned resolution. These rules contemplate informal but thorough investigations, affording all interested persons and their representatives, if any, an opportunity to submit evidence relevant to a complaint. This planned resolution will be within thirty (30) days of receipt of the inquiry form. This time will allow for the ADA coordinator to visit the location or conduct an investigation into the issues.
- The board shall make a final resolution within sixty (60) days of the receipt of the complaint form. The final resolution shall be specific as to the improvement of processes or procedures governed by Title II, consistent with federal and state law.
- The board’s final resolution shall be in writing and provided to the Complainant.
American Disability Act (ADA) guidelines for voting booths
The Kenton County Clerk’s Office strives to make voting accessible to all voters, regardless of disability. The office follows the American Disability Act (ADA) guidelines for voting booths, which include the following:
- Voting booths must be accessible to wheelchair users. This means that the booth must be at a height that is comfortable for wheelchair users to use, and there must be enough space for a wheelchair to fit inside the booth.
- Voting booths must have accessible voting equipment. This means that the equipment must be easy to use for people with disabilities, and it must be accessible to people who are blind or have low vision.
- Voting booths must be located in accessible areas. This means that the booths must be located in areas that are easy for people with disabilities to get to, such as on the first floor of a building or in an accessible entrance.
The Kenton County Clerk’s Office also offers a variety of other accommodations for voters with disabilities, such as:
- Mail-in Absentee Voting
- Accessible Voting machines- Express Vote which has Braille and Audio capabilities
- A voter may go to any of the Early Voting or Election Day locations that best suit their needs
